Terms of Service
1. General Agreement
By booking or renting equipment from Xtreme Air Party Rentals & Event Services (“Company”), you agree to these Terms and Conditions.
2. Reservation & Payments
• A non-refundable deposit (typically 25–50%) is required to reserve your rental date.
• The balance is due before delivery or at event setup.
• Accepted payments: cash, credit/debit card, Zelle, or approved check.
3. Cancellations & Refunds
• Deposits are non-refundable but may be credited toward a future event (within 12 months) if cancellation occurs ≥ 7 days before the event.
• Weather-related cancellations may be rescheduled at no additional charge, subject to availability.
4. Delivery & Pickup
• Standard delivery includes setup and teardown at the customer’s location within the Fort Myers area.
• The customer must ensure clear, level, and safe access for delivery crews.
• Additional fees apply for stairs, long carries, or deliveries outside our regular radius.
5. Equipment Responsibility
• The renter assumes full responsibility for equipment while in their possession.
• Do not move inflatables or equipment once installed.
• Damage beyond normal wear or lost items will be billed at replacement cost.
6. Safety Rules for Inflatables and Entertainment
• Adult supervision is required at all times.
• No flips, wrestling, food, drinks, shoes, or sharp objects in inflatables.
• Our attendants or staff have authority to stop unsafe behavior immediately.
7. Liability Waiver
The customer acknowledges that participation in physical activities carries inherent risks. By renting from or hosting an event with Xtreme Air Party Rentals & Event Services, the customer agrees to release and hold harmless the Company, its owners, and employees from any claims of injury, loss, or damage resulting from use of our equipment or services, except in cases of proven negligence.
8. Staffed Events
For events with bartenders, servers, or entertainers:
• Staff will provide services only as agreed in writing.
• The customer is responsible for compliance with all applicable alcohol laws and permits.
• The Company reserves the right to remove staff or stop service if unsafe or unlawful conditions occur.
9. Weather Policy
For outdoor rentals, safety is our priority. If winds exceed 20 mph, lightning is present, or heavy rain creates unsafe conditions, we reserve the right to cancel or suspend operations without penalty.
10. Indemnification
The customer agrees to indemnify and defend Xtreme Air Party Rentals & Event Services against any claims, damages, or legal fees arising from misuse or negligence during the rental period.
11. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes will be resolved in Lee County, Florida.
